Terms of Use

This agreement is between you and Pham Quoc Hoa, an individual developer ("I", "me"), and governs your use of the Puracam application for iOS ("the App"). By downloading or using the App you accept these terms. If you do not accept them, do not use the App.

1. Licence

You are granted a personal, non-transferable, non-exclusive licence to use the App on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. The App is licensed to you, not sold.

You may not copy the App except as permitted by that licence, reverse engineer, decompile or disassemble it except to the extent applicable law expressly permits, rent or sublicense it, or remove any proprietary notices.

2. Your content

Scans you create are yours. They are stored on your device and I claim no rights over them. I also have no access to them — see the Privacy Policy.

Because your scans exist only on your device, you are responsible for backing them up. Deleting the App, losing the device or a device fault will lose them, and I cannot recover them for you.

3. Subscriptions

Some features require Puracam Pro, an auto-renewing subscription sold through the App Store.

Subscription options, their length and their current price are shown in the App before you buy and on the App Store listing. Prices vary by territory and may change.
A free trial may be offered to eligible new subscribers. If you have used a trial in the same subscription group before, you may not be eligible again.
Payment is charged to your Apple Account at confirmation of purchase.
The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
You can manage or cancel a subscription in Settings → your name → Subscriptions on your device, at any time. Cancelling stops the next renewal; the subscription stays active until the end of the paid period.
If a free trial is running and you cancel during it, no charge is made. Any unused part of a free trial is forfeited when you buy a subscription.
Refunds are handled by Apple under the App Store Terms of Service, not by me.

4. Acceptable use

You agree not to use the App to break the law, to scan people or private property where you have no right to do so, or to infringe anyone's privacy or intellectual property. You are responsible for having permission to capture the places and objects you scan.

5. Accuracy — please read

Puracam produces approximations, not survey data. Scan quality depends on the LiDAR sensor, lighting, surface material and how the scan is performed. Reflective, dark, transparent and glass surfaces frequently produce gaps or wrong geometry. Measurements taken from a scan carry error and must not be relied on for construction, manufacturing, legal, medical, navigational or safety-critical purposes without independent verification.

6. Availability and changes

The App is developed and maintained on a best-effort basis. Features may be added, altered or removed between versions, and support for older devices or iOS versions may end. Continued availability of the App or of any specific feature is not guaranteed.

7. Disclaimer of warranty

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. No warranty is given that the App will be uninterrupted, error-free, or that any defect will be corrected.

8. Limitation of liability

To the maximum extent permitted by applicable law, I am not liable for indirect, incidental, special or consequential damages, nor for loss of data, loss of scans, loss of profit or business interruption, arising out of or relating to the App. My total liability under these terms is limited to the amount you paid for the App and its subscriptions in the twelve months before the event giving rise to the claim.

Nothing here excludes liability that cannot be excluded by law, and some jurisdictions do not allow the exclusions above, so parts of this section may not apply to you.

9. Apple

This agreement is between you and me, not with Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide any maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Any claim relating to the App's possession or use — including product liability, a failure to conform to legal requirements, or a claim under consumer protection or similar legislation — is my responsibility and not Apple's. In the event of a third-party claim that the App infringes intellectual property rights, I am responsible for its investigation, defence, settlement and discharge.

Apple and its subsidiaries are third-party beneficiaries of this agreement and, upon your acceptance, have the right to enforce it against you.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

10. Termination

This licence is effective until terminated. It ends automatically if you breach these terms, and you may end it at any time by deleting the App. Sections 5, 7, 8 and 9 survive termination.

11. Governing law

These terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-law rules. If you are a consumer, this does not deprive you of the protection of mandatory consumer law in your country of residence.

12. Changes to these terms

These terms may be updated as the App changes. The date at the top will be changed, and continuing to use the App after an update means you accept the revised terms.
